ЁЯУЭ A Small Change That Could Make a Big Impact in Company Incorporation

To the Ministry of Corporate Affairs (MCA), Government of India
As a practicing Company Secretary, I, CS Hannu Goyal, wish to bring attention to an area of the SPICE+ name reservation process that could be refined for greater efficiency and fairness.

Current Concern:

Presently, when a company name application is rejected on the SPICE+ portal, applicants are allowed only one resubmission attempt. In contrast, the LLP name reservation system offers two resubmission chances.
From practical experience, I have seen that many name rejections occur due to:

Minor typographical errors

Interpretational differences in name similarity

Discretionary rejection on grounds that could be clarified

Having only one chance to correct such issues often leads to:

Additional application fees

Time-consuming delays

Frustration for entrepreneurs

A complete restart of the process

Suggestion:

Allow two resubmission attempts for company name reservations under the SPICE+ system, just like LLPs.

Benefits of This Small but Meaningful Change:

тЬЕ Reduces unnecessary delays and costs for startups and professionals

тЬЕ Ensures fairness and parity between company and LLP incorporations

тЬЕ Promotes Ease of Doing Business, encouraging entrepreneurship and reducing red tape

This proposal aligns with the governmentтАЩs vision of promoting a business-friendly environment and improving regulatory processes for professionals and new businesses alike.

ЁЯУй I humbly urge the MCA to consider this recommendation as a step toward enhancing India’s business incorporation ecosystem.
